Transcript of the Will of WILLIAM KISBY 1813-1897, farmer, of Coates-in-Whittlesey, Cambridgeshire, died 17th January 1897. Probate Peterborough 9th June to William Kisby and Charles Kisby, farmers.

This is the last Will and Testament
of me William Kisby of Coates in Whittlesey in the Isle of
Ely in the County of Cambridge Farmer as follows (that is to say)
I hereby revoke all other testamentary dispositions heretofore
made by me and declare this to be my last Will. I appoint
my sons William Kisby and Charles Kisby Executors and
Trustees of this my Will and I devise and bequeath to them
their heirs executors administrators and assigns all Estates
vested in me as a Trustee or Mortgagee subject nevertheless to the
equities affecting the same respectively. I appoint the said William
Kisby
and Charles Kisby and the survivors or survivor of them or the
executors or administrators of such survivor or other the Trustees or
Trustee for the time being hereof (hereinafter called my Trustees)
to be the Trustees or Trustee for all the purposes herein expressed
and also for all the purposes of the Settled Land Acts and of
section 42 of the Conveyancing and Law of Property Act 1881.
And I declare that new Trustees may if necessary be
appointed for all the purposes aforesaid under 31 of the last
mentioned Act. I bequeath all the household goods and furniture
consumable stores and provisions and effects which shall be in and
about my Dwellinghouse at the time of my death to my daughter
Alice Kisby absolutely. I devise all that piece or parcel of land
situate near the "Stag and Hounds" publichouse in Coates aforesaid
containing three acres (more or less) unto the said Alice Kisby her
heirs and assigns for ever. And I bequeath and devise all the
rest residue and remainder of the personal and real estates of or
to which I shall die beneficially entitled unto my trustees upon
trust that my trustees shall sell all in and convert into money
the same or such part thereof as shall not consist of money and
shall with and out of the monies produced by such sale
calling in and conversion and with and out of my ready money
pay my funeral and testamentary expenses and debts (including
Mortgage debts) and shall also pay to my son the said William
Kisby
the sum of Eighty pounds the price or sum agreed between
us to be paid by me or be allowed and paid to him out of my
residuary estate as compensation for or repayment to him of the
cost incurred and borne and the money expended by him
in building the Dwellinghouse now being upon the parcel of land
containing ten acres (more or less) belonging to me situate near
Beggars Bridge in Whittlesey aforesaid And shall stand possessed
of the monies then remaining in their hands herinafter called my
residuary trust funds In trust for my children Betsey Atkin,
Ann Blunt, Martha Bowd, Harriet Brooks, Susan Gray, Eliza
Gray,
the said William Kisby and Charles Kisby in equal shares
Provided always that if any of my said last named children
shall die in my lifetime leaving a child or children who shall
survive me and being a son or sons shall attain the age
of twenty one years or being a daughter or daughters shall
attain that age or marry then and in every such last mentioned
case the last mentioned child or children shall take (and if
more than one equally between them) the share which his
her or their parent would have taken of and in my
residuary trust funds if such parent had survived me. And
I declare that if any Granddaughter of mine shall marry while
an infant the income of the share (if any) of my residuary trust
funds to which she shall for the time being be entitled in possession
ander this my Will may be paid to her during her infancy and
her receipt shall be sufficient discharge for the same. And I
also declare that my Trustees may raise any part or parts
of the expectant share of any Grandchild of mine under this my
Will and apply the same for his or her education advancement
preferment or benefit as my Trustees shall think fit. In witness
whereof I have hereunder set my hand this twenty third day of
October One thousand eight hundred and ninety six.
